Entitled to property in Mexico

Posted on: 06th Jun, 2007 04:30 pm
As an Executor and Beneficiary of my Uncle's Will, along with four other beneficiaries (who live in Mexico) am I entitled to any property which my Uncle may have owned in Mexico? Even if the property in Mexico is not stated in the Will/Trust? Does the Executor make the final decision? Who has the last word?
Hi Freddy,

Welcome to Mortgagefit discussion board.

As property your uncle owned in Mexico is not mentioned in the will its distribution will be as per property distribution laws applicable in Mexico.

You need to contact an attorney in Mexico to know how ownership of that property will be decided as there is no will.

" Does the Executor make the final decision? Who has the last word? "

In US the executor is the person who has the responsibility of distributing property as per instruction specified in the will.

I am not sure how this procedure works in Mexico and it would be better if you contact an attorney in Mexico to know about the actual procedure that is applicable.

Do let me know if you have any other questions.

Thanks
Blue

Property laws in Mexico can be different from what they are in this country. As Blue said you should contact an attorney in Mexico to know how his property will be distributed if there is no will.

Hi Freddy,

The executor makes the final decision on behalf of the person who has made the Will. But he cannot own a property which is not stated in the Will.

In case you wish to know more on the Rights and Responsibilities of an Executor, refer to our section on this topic.
