Quit Claim

i purchased a home 2 yrs prior to getting married (we have been married 3 yrs) and added my spouse on via a quit claim deed. the loan and title or still in my name. i make all of the monthly payments via my personal checking account. we are contemplating divorce and his first question is what about the house? can i reverse the quit claim deed - (i prepared the deed as a single person and added it with both our names)? we filed it with the county clerk's office.

if you don't want the property, then you can sign a quitclaim deed and transfer your share of the property to your spouse and ask him/her to refinance the mortgage. this will make sure that you have no obligation towards the property or the loan.

Hello justlookin,

It does not guarantee that other people don't have an interest in the property. If there are other owners, their ownership is not affected by the quit claim.
