hi please help me which annoy me much. my husband is the loan applicant but the house is under my name and his. i suffer pain in marriage and wanna divorce and dont wanna take the house too. he then ask me to sign authority transfer for him to easy in doing refiance and he said he will hand in the quit deed after that for me.shall i trust him, do i owe any lability on the bank loan even i am not the one who apply for loan?pls advice.

i suggest you find some counseling for yourself and your spouse to see if you can work through the marital issues you described. ultimately, if you still cannot see eye to eye, it would behoove you to begin working with legal counsel to iron out the details of your relationship and your mortgage needs.

thanx george , but the problem is he is now in state but i am already gone back to asia.
do you have plans to come back to the us, soon; or in the not-too-distant future? such plans would undoubtedly influence how you handle this situation.
at this point, your spouse will probably be able to obtain a loan without your signature on any documentation, but if you are not present to sign a mortgage deed for the lender, then any lien they attempt to place on the property won't be valid. your signature would be required.
