quit claim with brother's name on deed

Posted on: 02nd Mar, 2013 08:00 pm
my brother has passed and we have a quit claim deed from my dad which states the property goese to both of us. can i just take the deed to the county office with a copy of my brother's death certificate and have the deed put into my name.
No. Your Brothers Estate is entitled to his portion of the property. If he doesn't have a Will or Living Trust, his Estate must go through Probate, and the Probate process will determine how is Estate is disbursed.

Welcome cynthia,

I agree with Raymond. The heirs of your brother can get your brother's share of the property. In that case, you can't claim the whole property.
