my dad recently passed and left no will,he remarried and has a daughter with the new wife.she has asked that to avoid probate she wants us to sign a quit claim form.we live in washington state which is a community property state.i just am curious if there are other reasons she wants this, like maybe he wanted us to have part or was there a will and she wants us to give away our rights and is not telling us.i just assumed community property meant she would get everything anyways,so why do we need to sign anything?

I think you should contact your real estate attorney before signing on any of the documents. This will help you know why she wants you all to sign the deed and get the property transferred in her name.

Sorry to hear about your father's passing.

I must agree with Sussane, consult your attorney before taking any action. They will assist you in whether you should sign the deed or not.

What were your Father's intentions? Did he ever tell you he wanted his Estate to be divided between his children and spouse when he died? If yes, his Estate should go through Probate so you have a say in the matter. If no, or if you don't want anything from your Father's, signing the Quit Claim will bypass Probate, but you won't have another opportunity to participate in how his Estate is divided.
