quitclaim deeds/gift tax

Posted on: 04th Oct, 2010 01:09 pm
I've been caring for my 86 year old Aunt since her husbands death 16 months ago. I have power of attorney but while that was being filed my Aunt's 82 yr old sis-n-law had her sign a quitclaim deed giving her ownership of her only asset, her home. I don't have the funds to care for her on my own, however I've also been informed that my Aunt will be receiving a bill from the IRS for approx. 43 -45% of the value of her property as a gift tax. Frantic here trying to get as much info as possible. Any Response is much appreciated!
Hi idlewindsouth,

If your aunt has transferred the property as a gift, then she will be liable for paying gift taxes. However, there is a lifetime gift tax exemption of $1 million. If she hasn't crossed this limit, she won't be liable for paying the gift tax.

Thanks,

Jerry
