Mom need help!

Thank you for this chance to get some good direction.
My Mother remarried 25+ years ago. When they married she was the one who came with the money to buy the Condo they are currently in.
She also since retirement choose to pay off the Condo with a lump sum from an inheritance. So the only thing that gives my Step Father a right to half of the Condo is the state law. They do have a living trust. My mother is very ill, and wants a divorce from my stepfather. He has been very mis leading in many of their finacial dealings. Im wondering if a Quitclaim would help take his entitlement of the property away from him in the event of her death. She is not able to go forward with a divorce, due to keeping her health going in the right direction. He makes it clear that he will not pay rent or move out in the event of her death.
Do you have any ideas as to where we can go with this matther...

If your mother is the trustee of the living trust and your father is the beneficiary, then she has the right to quitclaim the property in your name. In this way your father will have no interest left in the property.

Your mother can also revoke the trust with the help of a document saying that the trust has been revoked. For this document you need to consult a lawyer. After she revokes the trust, she can quitclaim the property in your name.

It depends on the terms of the trust. Check with a lawyer.
