Affidavit of Heirship

Posted on: 10th Nov, 2009 08:59 am
I need to file an affidavit of heirship so I can file a quitclaim deed on a piece of property in a county other than the one I live in. Should I file the affidavit in my county and then attach a copy to the quitclaim deed when I file it. Will the affidavit also cover my house that is in both my deceased husband's and my name if I decide to sell it someday?

Thanks,
Patty
Hi PCorbitt,

As far as I know, you will have to file an affidavit of heirship at the county recorder's office where the property is located. Once you do so, you would become the owner of the property. I don't think you will have to attach it with the quitclaim deed. Once you file the affidavit of heirship, you would be able to transfer the property in your name solely. Thus, you would be able to sell off the property on your own.

Take care.
