Quit Claim Deed on home that is about to be foreclosed on

Posted on: 01st Apr, 2009 12:38 pm
my mom want to do a quit claim deed with me on our family home that is about to foreclosed on due to back property taxes. the home is about to be sold next month and i wanted to know if she does that will that buy time for us to catch up on the back taxes?
Hi Dakota,

As the property is on the verge of foreclosure, if she transfers the property to you then it would be considered as a fraudulent transfer. She will have to first clear off the back taxes and then transfer the property to you.

Thanks

Hi

Transfer at this point isn't possible ina any way. Any such transfer would be considered as fraudulent conveyance and thus, can be reversed.

Yes, when you go down to the county to record your quit claim deed, they will as you if your taxes are current and reject your deed.
