My mother signed a quit claim deed some land to an individua

the property to another individual. fortunately, for me the legal discription on the original quit claim deed is incorrect. i filed a quit claim deed in my name to retain the property in my name. the quit claim deed was notorized and filed in the county clerk's office. since that time of 10 years, i have been paying the taxes on the property and the county tax notification has my name as owner. now, for this year taxes, the county assesor's office say that i'm not the owner because i do not own the land. doesn't the quit claim takes precendence in the situation?

What I understood from your post is that your mother had quitclaimed the property to another individual but the legal description was wrong. But I can't understand that - "I filed a quit claim deed in my name to retain the property in my name. " can you explain it a bit. Had you mother a will?

Now you have paying the taxes on the property for last 10 years and all of a sudden the county assesor's office, after such a long time, understood that you are not the owner of the property? What they have been doing for last 10 years?

If the legal description of the quitclaim deed that was made by your mother was wrong then as an heir you should be the owner of that property. So consult with an attorney immediately and try to resolve the matter.

a quit-claim deed does one thing and one thing only. it transfers title to "whatever interest" a person has in property to another person. so...if your mother had an ownership interest in that land, she transferred it to the other person.

how you could file a quit-claim deed by yourself declaring yourself the owner of the parcel of land is beyond me. unless you owned the property to begin with, all you accomplished was tranferring title to "nothing" to yourself.

generally, municipalities pay no attention to who writes the check that pays the taxes; so i would not be surprised that they not recognize you as owner (but of course, as noted above, you are apparently not the owner anyway).

how is it that you claim to be the owner, other than having paid taxes on the property (i feel sure the owner is grateful).

If she transfered the property to another individual prior to filing your quit claim then yours probably did not go through since it would have already transfered to someone else. I would contact an attorney in this case to help sort this out.
