Can I force her to pay?

My brother put his girlfriend's name on my mortgage and deed, (Iquick claimed it to him) now she just sits around and drinks all day. She refuses to pay anything on my home loan, and will not leave the house saying she is part owner. Can I force her to pay on this mortgage since her name is on it? Can I get her off the mortgage and deed if she refuses to sign anything?
i suppose you could grab her arm and twist it around her back and "make" her pay that way.

but seriously...how could your brother put her name on "your mortgage and deed"?? in order for her to be a party to either of those documents, you would have been involved as well.

if she is truly now an owner of this house, she must consent to relinquishing that ownership. you cannot "get her off the mortgage and deed" by yourself.

perhaps your brother ought to step up.

I am guessing it went like this -

You get a mortgage for the house,

You quitclaim it to the brother ( did he promise to pay for it?)

He put his girlfriend on the title and now they are not paying for mortgage

Well you are out of luck unless they agree to let the property go to you and/or start paying for it.

They are already on the deed. And you are on the mortgage ( hence you have the responsibility to pay it. )

eugene, i don't mean to criticize you, but after reading your post and re-reading my own, i think we come off as a little bit unforgiving in our commentaries. clearly, what we've read makes no sense to us - hence the remarks. i suppose we could have been more charitable.

that being said, i need to add this as well: i am flabbergasted at some of the scenarios i see and hear. i can fully understand the lack of knowledge that people carry into the real estate market, but i fail to get how it is that they seemingly make no real effort to acquire knowledge before they step off and undertake some of these transactions. i know that the educational system is not designed to give anyone much real-life training (wish it were), but it's baffling that folk don't understand the gravity of what is involved in dealing with real estate and with mortgages.

for most of us, these are the largest expenditures and/or sums of money borrowed in our lives. yet, we continually hear about folk who act as if they're investing pennies when they "quick" claim properties to strangers, boyfriends, girlfriends and the odd stubborn parent who they don't get along with anyway.

i am so grateful for the individuals who come to this forum for assistance, and for those who are dedicated to responding with a desire to help. there are a lot of despicable sorts out there who will prey on all those naive and uneducated buyers/borrowers, etc. we all need to be much more vigilant in our stance against the ills of the age - especially here in 2008 and ongoing.

when someone calls us and says they can save us thousands of dollars (unsolicited calls), we need to put our most skeptical faces on and question every statement made. it pains me to say i have to be extra-vigilant in my own home - my wife will hear that a mortgage company has called and left a message about our mortgage with "not named" and she'll think that it's the real company calling and that we have a problem. only when i check caller id (i didn't used to believe in that!) do i see that it's some scam artist who knows the name of our actual mortgage lender and is using that to try to steal from us.

people, i pray that you're staying away from those who promise miracles - there is only one miracle worker, and He is in full control of all things.

everyone: please be careful. our times are exceedingly difficult, and without being watchful, we can all fall for the schemes and traps that are being set for us.
