JOINT TENANTS WITH RIGHT OF SURVIVORSHIP

Posted on: 12th Dec, 2008 10:09 am
my sister and i are joint tenants i paid for the condo i jjst added her name when it was bought in 2002 she is going to take her name off. is a quit claim or waranty deed better.
Hi RANDYE,

Your sister can use a quitclaim deed to transfer the property to you. Your sister will get sample quitclaim deed forms online but she can draft it from an attorney even. You can check out the following link to get some sample quitclaim deed forms:
http://www.mortgagefit.com/predeal/quitclaim-stateforms.html

However you should note that if she quitclaims the property to you, then the joint tenancy with right to survivorship will be severed.

Thanks
