Quit Claim Deed and Refinancing

Posted on: 26th Mar, 2009 01:41 pm
when my ex-husband and i divorced, they had me quit claim the deed to our home to my ex-husband. it was included in the divorce papers that my ex was to refinance the home within a reasonable amount of time so i would no longer be liable for the house payments. that was in 2005, this is 2009 and he has not complied. i believe he may have filed bankruptcy, but even if he didn't, he has moved out of the state and is not making the payments. what, if anything, can i do. it shows on my credit report that i have a $57,000 mortgage. someone please help.
I would consult an attorney, especially since you had it in your divorce papers.

Hi lshields,

He should definitely have refinanced it in his name. You can get in touch with the lender and submit them copies of the divorce decree and the quitclaim deed nd request them to remove your name. If that does not work, you should immediately contact an attorney.
