My husband just walk out and informed me he wants a divorce. We just finished a re-fi on the house. He is the main borrower and i am the co-borrower. He wants to give me the house. Can he quick claim it to me? And if so, if i pay the mortgage how can i guarantee he wont come back and want the proceeds one day from a sale?

yes, your husband can sign a quitclaim deed and transfer the property in your name. once the property is transferred in your name, you will have to refinance the mortgage in your name. this will release him from the obligation of paying the mortgage dues.

once the property deed is transferred in your name, the property will be solely yours. in that case, he will not will not be able to claim any kind of proceeds from the sale of the property in future.
