quit claim deed

my step father has cancer, he wants to leave his house to me and my sister who is adopted by him. he would like us to not have to go thru probate with a will.. he has an attorney who is going to have us do a quit claim deed to give us the house. is this the best way to go about this?

If there is a mortgage on the property, then your step-father can sign a quitclaim deed and get the property transferred in your name and your sister's name. If the property is free and clear, then your step-father can use a warranty deed in order to get the property transferred in your name.

Hi labrylao,

The attorney has given you a goo option to get the property transferred in your name. A quitclaim deed will suffice your needs. If you wish, you can even add a life estate clause in the deed which will help you step father to stay in the property until death.
