quit claim deed

my husband and i divorced in 2008. i surrendered our home property to him and moved to another property that we had. i found out the mortgage in the property he is living in is still in my name. i've asked him on numerous occasions to get the mortgage in his name, but he doesn't have good credit to do so. now he is wanting me to sign a quit claim deed. what impact will this have on me and what are my options?

If you sign a quit claim deed, it will help you in removing your name from the property deed. However, it won't help you in removing your name from the mortgage docs. Thus, you will still remain liable for the loan unless he refinances the loan in his name.

Hi,

I think your husband wants you to transfer the property in his name, so he is telling you to sign a quit claim deed. However, if you sign a quit claim your name will not be in the property but as you have signed the mortgage, you are still liable for the loan. Take the help of a lawyer and check your divorce decree and if possible send a legal notice to your husband to refinance the loan in his name.
