my mom died and i found out my sister who owens half of my moms house did a quit claim deed and took my moms name off cause she was on ssi ? she was having to be put in a 24 care nursing home, and she said the state would take her house to help pay for the care.. is this true?even though my sister owed half?and how does her name get off the title?
Hi sugarfoot,

Your sister cannot take your mother's name off the deed after her death by using a quitclaim deed. She needs to file an affidavit of heirship in the county recorder's office. As far as removing your sister's name from the property is concerned, you need to consult an attorney in that regard. If she signs a quitclaim deed and transfers the property to you now, she may not remain eligible for medicaid benefits.

Thanks
