Quit claim before marraige ends

I am in the proess of getting a divorce, but my "husband" has agreed to sign a quit calim deed now. Can he do that in the state of MN, or do we have to be oficially divorced first? I am in the process of selling the house an would rather have him not be involved.

If your husband is also on the title of the house then you will not be able to sell the house without his signatures.

Another thing is that if divorce proceedings have started then property division will be decided by the courts.

if your husband has agreed to sign the quit claim deed then it means that he wants to give up whatever interest he has over the house back to you.

why you have any objection to that?

but it is confusing as you are also saying that you are trying to sell the house, does it mean that you solely own the house? if your husband also owns it along with you then you will not be able to sell it without his consent.

please correct me if i have misunderstood your post.

agreement no action right? Dower rights are an issue as far as your ability to negotiate a sale and transfer marketable title. This is a state law issue; check with your attorney. Could be he's "agreed" now and will transfer with divorce and the cancellation of dower. Legal and tile question -- see these folks for better information.

Since you and your husband are separating by law, let the law take its own course. I would suggest you to consult a lawyer.

Your husband can only quitclaim after the divorce through a legal action is over. During the divorce through court action, you can claim the property and if that is granted, then after the legal course is over, your husband can sign over the deed to you. However, if you're going through some mutual understanding in divorce then your husband may quitclaim the property before the divorce ends.
