Quit claim deed

We purchased a home from a friend. He left town 3 years ago and we never transferred the deed into our name. We are having trouble getting copies of the tax has it is due. Can we send him a quit claim form, have him fill it out and get it notarized to have the property transferred into our names. I have family that keeps telling me that the city will take the property because the owner abondoned it. We always have to wait until the house is behind on taxes, thats the only way we find out how much is owed. I don't want to put more money into the property if the city can take it from us.

Hi Evelyn,

You are saying that you just gave your friend the money and he gave the keys for the house but no deed was signed for recording the transfer? If that is the situation then you can record the deed now. You can send him the deed and get his signatures on it and then get it notarized and recorded with county recorder's office.

After the deed is recorded you will not face the problems you are currently having with the taxes.

in some states it is required that the grantor as well as the grantee signs the deed in front of the notary public.

so you need to confirm whether a pre-signed quit claim deed by the grantor would be acceptable at the time you take it for notarization or he will be required to sign it at the notary office.
