how can i get xs name off mortage without refynancing due to divorce settlment

generally, one should refinance the mortgage in order to remove the other person's name from the mortgage docs. however, as you do not want to refinance, you can check out the option of novation with your lender. this is also a method of transferring the mortgage from one person to another. but, lenders always prefer refinance over novation.
