Trying to refinance w/ fair credit

due to my mortgage being changed, starting in 2007 from grange bank to franklin bank in june '07, and franklin bank was under countrywide, then under bank of america, my records of my mortgage payments were so screwed up. franklin bank originally said i was 12 months behind in '07, went to a review dept., faxed over all of '07's payments, then it came down to that they said i didn't pay grange bank (per franklin bank) may and june'07 payments, which i did, and i provided proof. they still kept me behind, charging late fees, and then countrywide sent me a letter, dec. '07 apologizing for all the inconvenience, and that three last payments i had made were applied up to dec. '07. come jan. '08, franklin bank is still adding on late fees due to still not budging that i owe 2 payments from grange bank, which grange couldn't provide records whether i paid or not (which i did, i do have proof) per franklin bank. on sept. '08, franklin bank sent back 2 months mortgage payments to me for aug. & sept., stating that i owe over 6k now (including late fees), and not accepting til paid in full. i've luckily kept all records....in aug. '09, one person at "now" bank of america was working on this on behalf of franklin bank...he was the only person i was to contact and that he and he alone was working on this.
i called him later in aug., he was suppose to be working on a modification for me, he said he dropped the ball, was so busy. on franklin bank's site, per ny times, franklin bank in tx was shut down by the fdic in nov. '07 due to "bad record keeping"....they continued and went under the name of countrywide they were still franklin bank in '08 and '09...now mortgage has been turned over to green tree as of dec. '09. they weren't taking any calls from the borrowers til the end of december. when i talked to the debt collector, where my call was routed to, he wants $2,300.00 now (ok) plus $8,500.00 in 30 days or i'm in foreclosure. mind you, i sent them all payments i made for '07 and '08, still in research and he said i'm sure it's not done yet. plus, he's going on franklin bank's records as to what i owe now. asked what did i do with the money, wasn't i putting it aside. yes, i was. first, i needed a car due to mine breaking down, tried to trade it in plus get a 3k loan, turned down due to bad credit, thanks to franklin bank. had to pay cash, i have go to work. i finally thought that maybe this last guy from bank of america on behalf of franklin bank (in aug. '09) was working on a modification we discussed. and green tree won't discuss a modification w/me, when i didn't cause this whole situation. i tried to pay my mortgage, they refused it. i tried to talk to two different lawyers while this was happening, it was such a mess, didn't want to take it on. now i'm contacting legal services and trying to refinance before it does go into foreclosure. any advice to who i should try to refinance with or turn to?
Unfortunetly at this point a refinance is not going to be an option. You will not be approved due to the delinquent mortgage payments that will show on your credit. You need to seek professional help and start working a modification. You seem to have a valid point of the bank making a mistake. You need someone to represent you and to make sure this gets cleared up ASAP!

I find it hard to believe that green tree wont work on a mod for you. Its probably just the collection people you talked to at first. They want to see what they can get out of you. I would contact them again and ask to speak with a manager explain your story to that manager and ask them to consider you for a modification.
