my name is not on the mortgage

Hi there i was wondering if anyone could help me i live with my boyfriend our son and have just found out im pregnant again his name is the only name on our mortgage as i have very bad credit so we didnt want to risk not getting a mortgage i give half the money for the mortgage every mth but it comes out of his bank so i have no proff that i give him the money how can i get my name on the mortgae of our house and protect me my son and my new baby if anything bad happens between me and my partner

if you want your name to be added to the mortgage, you need to refinance the loan in both you and your partner's names. however, you can also check with your lender if they can add your name to the loan through novation. if you want to ensure you have an interest in the property, you must have your name on the property deed. it is more important for you to have your name on the property deed than on the mortgage. being only on the mortgage does not entitle you to an interest in the property.

my name is not on the mortgage but i have filed occupancy rights i have 3 children my husband says he is not paying the mortgage but the dwp say they will pay the interest i have sent them a mi12 form but they will not cooperate without my husbands say so and he is trying to loose the house my solicitor has filed to the court for ancilary but how can i get the mortgage co to cooperate and allow the dwp to pay to save the house being repossessed before the courts can intervene

To sarah,

The Department for Work & Pensions will not help you with the mortgage interest payments until the mortgage is in your name. They will work only with your husband as he's the person responsible for the mortgage payments. I think what you need to do is, talk with the lender and check out if there's any option to add you to the loan. You can refinance to get the loan in your name and pay off the existing mortgage to save the house. But given your financial situation, it doesn't look like you can qualify for refinance at present.
