mortgage and title

Posted on: 26th Feb, 2009 07:54 am
i recently lost my job and just refinanced my mortgage from 15 to 30 years to help with cash flow. because i have no income, i couldn't refinance without putting my fiancee on the mortgage. my name is the only name on the title. now, we do not have a pre-nup yet....if his name is on the mortgage, does he own half the house? the reason i ask, is that there is over 500k in equity in the home and the mortgage is only 175. any guidance you can give would be great. we will be getting married shortly, but until the pre-nup, i am wondering if this may put me in harms way?
Depending on the state you live in, if its a community property state, he will own half the house anyway.

He is on the mortgage and NOT title?

Hi lala,

Since his name is only on the mortgage and not on the title, he has got no share in the property. However, as Ashley mentioned, if it's a community property, once you get married he'll be entitled to half the property.

Thanks,

Jerry
