Hi-I am in the process of filing personal bankruptcy. I have a 1st & 2nd mortgage,however my 2nd mortgage does not show up on any of my county's records and they are 2nd in line. I am current on my 1st. Does that release me from liability on 2nd if not recorded? Can they still claim anything? It has been sold 6 times since I obtained it in 2000. Thanks! Joe

if the second mortgage is not recorded, it means that it does not exist. if the lender cannot prove that the loan was made, you won't be liable for paying anything to the second mortgage lender.
