Does my husband have to sign deed of trust with a anti-nuptial

I have a anti-nuptial agreement that protects my assests from the past and future. I am currently separated from my husband awaiting divorce procedings. I am trying to purchase a home in only my name. The process is at the end with closing on Friday. However the lender is now saying my husband must sign a Deed of Trust. They said this is TN law due to the marital situation. Does he have to sign or is there a legal way around this?

Yes, it is better if your your husband signs a deed of trust. There is no other legal way for this. Through the deed of trust, there will be a third party who will look after if he pays the mortgages on time. If he cannot, the trustee will have the right to foreclose and sell off the property.

I have anti-nuptial contract without accrual, I've got my assets i.e propety and my husband hes got his. I just want to know what is going to happen to my my property and to his in case of death.

Hi PATIENCE,

An ante-nuptial agreement states how the properties are to be divided among the spouses in case of a separation. It usually does not state anything on what would happen to the properties once they have been divided as per the agreement. It is now up to the spouses as to what they are going to do with the properties. You can put it in a trust or can transfer it to someone else. You are free to do whatever you like with them because you are now the sole owner of the property.
