on 8-17-2009, my son had an accident and hit the concrete wall on the freeway. he didn't hit anyone. The officer told us that the car was totaled and if we let the tow truck too the car they would auctioned it, and we would not have to pay anything. We have AAA and could have called them. The accident was less than 3 miles from our home. We weren't thinking at 2:30 am, we allowed the wrecker to take it. Now almost 8 months later we receive a collections letter telling us we owe $3,200 for storage fees. we were not notified that they had the car, and that they were going to charge us fees for the car, otherwise we would have picked it up. Now in texas if we do not pay, can they put a lein on our home or the property?

If you do not pay the dues of the collection agency, they would sue you for the debt. Moreover, it will also affect your credit score badly. As far as placing a lien on the property is concerned, I don't think they would be able to do it. However, you can speak to an attorney and he may help you in this regard.
