Add my name in the title

Hi,

Recently my mother passed away and now my father is the sole owner of our family home. I am the only child of my father and he has no will. My father’s new girlfriend is living with him. Should I ask my father to add my name in the title? And if I am not in the title and my father passes away, can I ask his girlfriend to leave the home :?:

Hi Olivia,

I feel sorry to hear about your mother. What I would suggest is that you and your father should talk to an attorney about the title of the property. Because if your fathers girlfriend is added in the title as a joint tenant and has the right of survivorship then she would be the owner of the house after your father, even if you are entitled to be owner of the house being the sole heir of your fathers estate.

Hi,

Yes Jill is right you should look to talk to a attorney to discuss estate planning options with this house such transferring this house to a trust and you being the trustee.

Coming to your second question

If your fathers girlfriend is not in the title and when your father passes away, she will be a month to month tenant. And if you are not in the title to the home at that time being the sole heir of your fathers estate you are entitled to send her a written notice to move out from the house within 30 days.

I AM A WIDOW AND WISH TO ADD MY SON'S NAME TO THE TITLE OF MY HOME. HOW DOI I DO THAT.

Hi jan,

You can add your son's name to the title through a quitclaim deed. You will have to get a quit claim deed drafted by an attorney and sign the deed as grantor. Both you and your son will be grantees. After signing the deed, get it notarized and recorded with the county recorder's office.
