I had to file chapter 13 bankruptcy after a messy divorce and Child Custody Modification. The Court awarded me the Manufactured Home on 19.19 acres with no equity. The property was foreclosed. I have full-custody of my daughter now. I recently found the title to the Manufactured Home and it is free and clear with no lien holder listed. I'm in Missouri. Is the home mine? Through all of the anxiety of the crappy court system I forgot that I had paid cash for that home. I just assumed the house was in the Mortgage. Everything originally appraised for $144,000. I tried to sell it for over 2 years during just as the housing crisis began and didn't even get an offer for $90,000. It had, about a $20,000 2nd Mortgage from the same credit union. I was a mess over all of the court issues. I just had a chance to do some research on the internet and figured out that I could have wiped out the 2nd Mortgage and done a Cram Down on the Mobile home and kept the property. Then the title for the manufatured home turned up. I went to the County Assesors office and found out in the Forclosure the house and property sold for $57,055 with a Special Warrenty Deed. The lady At the DMV told me nobody else shows up on the Manufactured Home Title. She thinks the Home is mine. I never received notice of foreclosure and didn't have a chance to retreive some personal items. If the home is mine, what should I do? My bankruptcy atty won't return my calls and the trustee office says they can't give me advice.

The court had awarded you the property. In such a situation, the property deed should be in your name. If that is the case, then you own the property free and clear. Thus, the home is yours and you can stay in that property without any problem.

You told the title of the manufactured home and moreover the home is free and clear with no lien attached to it. You should not get worried and can stay in the house happily.

The answer to your question cannot be determined from the details you have provided. Most likely if you "permanently attached" the manufactured home to the property it became "real property" secured by the mortgage and is now owned by the individual that purchased the home in the foreclosure sale or from the bank after the foreclosure sale.

You have attained the ownership of the property by a court decree. Importantly, the property is free of any liens. So you need not worry about its ownership.
