Do I lose my right to the house if I sign interspousal deed?

my husband and i just bought a house, i signed a interspousal transfer deed to him. Did i sign over all rights to the house, i am considered a tenant with him on the deed do i still have rights to the house
Hi Kate,

You've transferred your property interest to your spouse by signing an inter-spousal transfer deed. In such a situation, you won't be able to claim the equity that's acquired in that property.

i quit claim my property to my husband because we where in the process of purchasing another home, but my credit was not as good as his. we are now divorced and in the divorce decree my property was granted back to me. however the housing market is upside down now and i'm unable to refinance it. is there any other way to get him off my loan and my deed.

hi glenda,

you can contact the lender and apply for a novation in order to remove your husband from the mortgage. however, in most cases, the lenders prefer refinance over novation. you can ask your husband to sign a quit claim deed in order to remove his name from the property deed.

Hi, If I sign the transfer deed can I be liable if my exwife does not pay the morage or is late will i still be affected by it?

Hi Clinton,

An interspousal transfer deed will only help you in removing your name from the property deed. If your name is on the mortgage and your ex-wife does not refinance the loan, you will remain liable for the mortgage balance. If she is late on her payments or defaults the payments, then the lender can come after you.

Hi,

Hubby and I are currently separated and he left property three years ago.... I've paid all bills surrounding our joint property. He bought another home (in only his name) in that time and is the sole mortgage holder for "his" home. Am I entitled to any of "his" property interest if/when divorce finalizes?
He says he is willing to sign "off" our joint property....would an interspousal transfer deed serve to remove him from any rights to our joint property? And can it be done in PA even if not divorced yet?

Hi Cheryl!

Welcome to forums!

You won't be able to claim any ownership to your husband's property that he had purchased solely in his name. You can ask him to sign an inter-spousal transfer deed in order to get the property transferred in your name. This will make you the sole owner of the property.

If my husband signs interspousal grant deed and is taken out of title, can he refinance our house later on with me on the loan but only using his income to qualify?

The lender will want your husband's name to be mentioned on the property deed if he refinances the mortgage with you.

I just divorced and my ex-wifes name is on the deed but she agreed to sign over her percentage to me and it is stated on the divorce final judgement. I am trying to refinance and she is no where to be found to sign the interspousal transfer deed. What can I do legally?

Welcome Derjac,

You will have to contact an attorney and take his opinion in this matter. He can guide you as to what you can do in order to get the inter-spousal transfer deed signed by her.

My husband and I are cosigning on a loan for a house for my son. My husband said that escrow what's me to sign an interspousal grant deed. That would put my husband and son on the title. That means my husband would take sole and separate property without me. Is that a good idea?

If you sign the inter-spousal transfer deed, then you won't have any ownership rights to that property. In that case, you will be liable for the mortgage but have no claims over the property. I don't think this is a good idea.

I asked my husband for a for a qiutclain deed so the home is in both our names. Iam down as tenants wit rights of survivorship. All I want is to be added to the deed. There are no mortage paymetns. Before I start investing in the home for repairs and such, I want to know his children cannot take it from me, and or that I owe them anything.

You should ask your husband to sign a quitclaim deed and add your name to the property deed. Once he does so, make sure that he notarizes and records the deeds at the county recorder's office. This will make the deed valid and you will be considered as the owner of the property.
