Do I lose my right to the house if I sign interspousal deed?

my husband and i just bought a house, i signed a interspousal transfer deed to him. Did i sign over all rights to the house, i am considered a tenant with him on the deed do i still have rights to the house
I signed a quit clam deed 10 years ago to protect our home from a possible lien for my old debt. If my wife divorces me now will I lose my half of the house. Also in our will everything go to surviving spouse, what if she dies do I lose house because of quit clam deed?

If the property is in the name of your wife, then after the divorce, you won't have any claims over that property. She will be considered the sole owner of the property. You may lose the property because of the quitclaim deed.

my husband and i are in the middle of divoce. trading off the house for his pension, i want to keep the house and he keeps his pension. there is a morgage. what is the diference between signing of a quit claim deed and a interspousal transfer deed?.

Interspousal deed is a better option in this case as it will make you the sole owner of the property and your husband won't be able to claim any further rights on that property. I have already filed for divorce, child support was ordered, as well as, health coverage for our 14 yr old child. My ex decided to quit his job and go freelance. I had health insurance until I got laid off. Now it is a serious issue. What course of action can I take to have the health insurance enforced.

My husband let me sign quit claim before we move to the house. But he's on the mortgage name only, but the title is under our name. We're having problems right now, does it mean I can't have a share of the house if sold

Hi May,

If your name is mentioned on the property docs, then you will be considered as one of the owners of the property. In that case, you will be able to claim your share in that property.

ex wants me to sign a quitclaim deed, or intespousal grant dee so he can refinance right now with the interest rates so low. says he cannot refi without it. is this true?? should i sign?

Hi JoJo,

If you sign the inter-spousal transfer deed or the quitclaim deed, then you won't remain an owner of the property any longer. If you're staying in a community property state and are divorced or separated, then there are chances that the lender is asking your ex to get the deed signed by you.

1. Can't seem to get the mortgage company/title company to draft a correct "ISTD." The description of the legal property is not even correct (there is further language about 500 ft and below, mineral rights are not mine, blah blah blah). Does the description of the legal property need to include all of this 500 ft and below mineral rights are not mine, or is the normal description one would see on an ISTD or any Deed completely OK? Property: California.
2. Spouse already signed an ISTD when the home was purchased in 2009 , do I need/require a second one with a refinance? Spouse not opposed.

Hi SRT,

You can contact a real estate attorney and take his help in drafting the inter-spousal transfer deed. The real estate attorney will help you draft the correct deed. If your spouse has already signed the inter-spousal deed, then he/she doesn't need to sign another deed.

My parents helped me buy a house so both their names are on the deed and mine. I had to refinance, so I added my husband to the deed and now I owe more than its worth. My husband and I are now divorcing and we owe (mortgage) way more than what the house is worth. Is he still responsible for the loan? Is he entitled to the house?

If your husband's name is mentioned on the mortgage deed, then he is liable for the mortgage payments though you go for a divorce. If his name is on the property deed, then he will be considered as one of the owners of the property.

I am trying to find out what I need to do to help my mom. My dad was just diagnosed with a terminal illness and is trying to get all his ducks in a row. My mom used to be on the deed to their house but when they refinanced about 10yrs ago they took my mom's name off the deed. I need to know what I need to do to get her back on the deed they live in Los Angeles county California. what forms do I need? thanks
