How to file a quitclaim form State of AZ

I live in Pinal County and am currently on the deed for the home my husband and I own. I am not on the loan and we are divorcing. I need to quitclaim the home back to him, but I am unsure of the process or where to get the form. I have looked on the government sites but don't see any forms available for this. I assume I must file with the Pinal County Recorder?

I currently live in the home and he has said he is going to stop paying the mortgage. That is a whole other story in itself...but for 2 years we have sought help on our VERY upside down home, but with excellent payment and credit history the banks don't care. Now that I must find my own home he cannot afford to pay it. The bank has told him to stop paying the mortgage if he wants help. I want to make sure that God forbid should something happen and he goes into foreclosure I won't be on any public documents saying that I was involved in the foreclosure of a home. I currently have an "excellent" credit rating and I want to make sure there aren't any black marks on it. Any help is appreciated.

Thanks Jenkin. There are no lawyers involved though. Truth be told I cannot afford one. If I could I would just be having the lawyer do the whole thing from scratch. I am trying to go it my own. I have read different things about using different forms. Like if you are both on the deed and you are quitclaiming it back to the other you are supposed to use a 2 to 1 form.

It is good to use a lawyer to avoid any dispute in future. However, you can do it on your own as well. You can use a 1 to 1 form i.e. form used to transfer from one individual to another also. There you will be the grantor quitclaiming whatever share you have in the property to your co-owner who will be the grantee.

Help! I am trying to get my name off of the mortage of a home I no longer live in and my ex-husband does. He is willing to take over sole responsibility for the home and mortage, but I need to fill out a quit claim. The property is in Vermont and I now live in Tennessee. Can my documents be notarized in TN and still be recognized in VT? I cannot afford a lawyer and my ex is most unhelpful. Can anyone help?

Hi KT,

If the property is located in Vermont, then the quitclaim deed will have to be notarized and recorded at Vermont and not in Tennessee. If you record the deed in Tennessee, it won't be considered as valid in Vermont.

Can I still file QuitClaim Deeds on Arizona properties that were executed, signed, and notarized on Dec. 15, 2002 by a State of Ohio notary. Both parties were living in Ohio at the time the papers were prepared. If so, where does one take the QuitClaim Deeds in Phoenix, AZ. to get them filed and what is the cost. Thanks for your prompt reply. I need to get them filed before court hearing this coming Wednesday, March 3rd. Appreciate your help very much.

Hi GP,

The quit claim deed was signed way back in 2002. I doubt whether or not the deed will be considered as valid. You should first speak to a Arizona based real estate attorney in this regard. If the deed is considered as valid, then you will have to record it at the county recorder's office where the property is located.

As far as I can understand, your girlfriend's name is mentioned in the property deed. You will have to ask your girlfriend to sign a quit claim deed and add your name to the property deed.
