changing names on property deeds

How do I add my wifes name onto our property deed? i purchased it before we were married.
Hi terry.

Welcome to the forum. You can use a quitclaim deed or Interspousal Transfer deed to add you wife on the deed. BTW is it a mortgaged property?

No, free and clear (Michigan) Just purchased the property before we got married, then built the house also before we were married. We are in the proccess of doing our wills, and or trusts. Hantz Group in Michigan is handling it. Getting a trust quote is $1600 to do it all. Sound about right price? Thanks for the info! Terry

Hi Terry,

In your situation, using an interspousal deed will be better than a quitclaim. Such a deed is specially meant for property transfer between spouses.

My mother just went into a nursing home (82 stroke) She has 2 bank accounts. One we are joint, the other I have pwr of attorney. After 100 days she will have to apply for medicaid Total of the accounts,$20,000
Just what can we expect the state to take? Anyway we can shelter these assets in case she is able to return home? Thanks Terry

It's sad to hear of your mother's illness. Let's hope she'll recover in a short time.

Coming to your query, the state doesn't go for Medicaid Estate Recovery until the recipient passes away. Know more on the steps taken by Medicaid in order to retrieve the money they've provided.

Hi Gladys Nkuna,

If you want to give away your RDP property to another person, you can use a quitclaim deed. You can consult an attorney who will help you in drafting the deed.

Hi Stacey,

You need to file an affidavit of heirship at the county recorder's office and remove your mother's name from the deed. Once the affidavit is filed, property comes into your name.

Texas and most other states no longer accept a quit claim. Meaning, you can self file at the courthouse, but if you ever go to sell the property, the title company will not accept the quit claim and revert back to the original deed, which you wanted to avoid in the first place. Better method would be to have a special warranty deed to transfer the property.

You will have to refinance the mortgage in your name in order to remove your partner's name from the mortgage doc.

It is not mandatory for you to take the help of an attorney and you can definitely do it yourself. However, it is always better to take the help of an attorney and get the property deed drafted by him.
