Can I sue for Fraud?
New to this state, used Realtor to buy HUD foreclosed home, Realtor recommended Lender, Lender recommended the HUD 203k Consultant, 203k Consultant recommended the Contractor.
HUD 203k consultant draws up the scope of work HUD required to be done at our house, he gets his buddy friend contractor to look over the numbers and he agrees to do the work on the work write up, we enter into a FHA Homeowner/Contractor agreement, Mortgage company allows the homeowner to do NO WORK on the work write up but the consultant has my husband sign the Self Help agreement anyway, this was not in our closing documents so I knew nothing about this piece of paper, we close on our loan Aug 27, 2013 and all is set so begin with repairs being completed with 6 months. On Sept 4,2013 the contractor gives my husband a contract and says he needs to sign before the work begins, my husband does what he requested. So the work begins. kids and I come for a week Thanksgiving break, we have no power in the home or any heat, we rough it for a week using the outside porta potty in freezing temperatures. The Consultand and Contractor come to hubby and I for the 1st draw, we signed the draw request not know what they did, we trusted the 203k consultant to inspect the work. when I questioned why there was no work done in the home, they told me we did not have any money to do the work, we borrowed over 100,000.00 and that was the total price on the work write up, we all agreed to, inside and outside repairs.
I am living in another state while repairs are done, with our kids, my husband in living in home while repairs are being done. My husband works 3rd shift and sleep all day he is not watching their every move. In December we move into the home, there is still nothing inside the home touched and I mean NOTHING!! January 22 the Consultant and Contractor come to get the 2nd draw and close out the loan, I told them I would not sign because the work inside the home was not done, they again tell me that we had no money to do the work inside our home. These guys have been verbally abusive to me both times I had asked, well this time I knew the work was not even attempted so I was not paying them, the end of the 6 months was February 27, 2014, when they realized I would not sign the papers they told my lender and he sent me a nasty email threatening me that if I did not sign the papers that he would report me for being uncooperative, and told me he had never had anyone refuse to pay the contractor money due him, when I told him the work was not done, he told me I was fabricating the whole story, he said the consultant and the contractor signed off that all the work was done. Since that December meeting I got at least a dozen calls from the consultant trying to get me to sign the papers to release the funds to the contractor or I would default on our loan, one of the calls even has him snickering. after the end of date Feb 27, I was served with a Lien on our home, and last week I was served a civil suit they are suing me for more money than we started with, his attorney is his wife. After all this mess we decided to hire a NC Home Inspector to look over our house, he said this house has so many violations that it should have never been sold to us. Lots of things wrong that HUD would have never agreed to, the HUD 203k Consultant lied to HUD about the condition of this home. I contacted out Realtor twice and she has refused to come and see the work not done, and has shunned me both times. I am beginning to see that we have entered into this deal with a group of deceitful people. I have an attorney now but he is only going after the contractor, can I sue the rest of this group too?
